Summary/Abstract: Throughout the 19th century, there are documents proving the existence of labor relations sufficiently complex, in which we can identify the foundations of the fundamental labor law institutions of nowadays, which leads us to the conclusion that labor law developed as an independent branch, with its own institutions that have perfected in time. Also, the documents attest the existence of individual labor contract before the entry in force of the Civil Code of 1864 which means that, in the development of the Romanian legal system, the Civil Code has no influence over the individual labor contract since there is no substantial difference in individual labor contracts concluded after the entry into force of the 1864 Civil Code.
