Summary/Abstract: There are juridical, historical and political dimensions of the conflict created by the Armenian genocide allegations. The International Court of Justice may not take a decision on this issue because of statutary limitations. The freedom of expression should be respected with regard the dissenting opinions on the issue of the qualification or not of certain events as genocide If persons are condemned by national courts, on the ground of their justified opinions on the subject, the victims may bring the issue to the European Court of Human Rights. As this is a juridical matter, the historians or parliaments are not habilitated to decide whether or not the crime of genocide has been committed. The power to decide on this issue belongs to the competent tribunal. The conflict we face today is merely political. An eventual solution should be conform to international law.
