THE ISSUE OF THE POLICE AND JUDICIAL COOPERATION IN THE EUROPEAN UNION

Summary/Abstract: Police and judicial cooperation was first mentioned in the Maastricht Treaty, it represented the subject of Pillar III of the Treaty of Amsterdam and acquired mutual recognition in the Treaty of Lisbon. This cooperation is very important for the EU, being possible only through cooperation of all the police and judicial authorities of the Member States and the Advisory Group Summit discussed the future of the Police Justice in June 2008. Reorganization of the judicial cooperation is difficult, given that Member States are afraid of losing the national identity and the essential skills in fighting crime. Another issue concerns the responsibility of the police at the frontier passage and the judicial cooperation, which one tried to be removed by the Treaty of Lisbon. However, as long as there are no clear and explicit skills of power between the European legislators and those who make policy, the democratic and judicial liability will be a problem.
