Key Decisions of the French Constitutional Council

Summary/Abstract: This article analyses the key decisions of French Constitutional Council that have the fundemental impact on its own legal and politic position, evolution and emancipation. Individual decisions are focused on following areas: the competence of the Council with regard on the law enacted in the referendum, the Preambule of the French Constitution and its obligatory nature, the examination of the division of the powers between Goverment and Parlament, and finally the possibility of the control of ordinary law in relation with the international treaty. All decisions are analyzed in historic and political context and presented with relevant legal argumentation.
