Cancellation of Gift Deeds between Spouses after Divorce under the New Family Code

Summary/Abstract: CIVIL LAW // The author thinks that the Family Code must correct an omission and provide that the cancellation of gift deeds, now made in notary form or in writing with notary certified signatures, shall be brought to court. The right of gift deed cancellation shall be exercised within a term of one year as of the date of the divorce. The spouses should not be entitled to determine in the marriage contract whether the afore-mentioned cancellation shall take place in court or not, nor should they set the term within which it shall take place. Such a right would harm or threaten the legal security of the civil turnover.
