Summary/Abstract: The purpose of this work is to study the possibilities for further harmonization of the regulation of the prescription, taking into account the principles of those who depart from both the principles of european contract law (pecl) and the common draft frame of reference. It is also taken into consideration the regulation of the statute of limitations in Spanish and Romanian civil rights. The regulation of the spanish civil Code is from 1889 and has not undergone any changes hitherto. Instead Romania has a modern code, the new civil Code [Law no. 287/2009, republished in Official Gazette no. 505/2011].
