Summary/Abstract: Constitutional democracy, only juridically guaranteed, is developing a proccess of changing that is affecting to large parts of Europe motivated by economic crisis that it is strongly plaguing to states like Greece, Italy, Spain and Romania.This trend is accompanied by the appearance of corruption, and by the citizens´ perception of the government´s inability to respond, resulting in political responsibility. Fixing our attention on the Spanish case (which is extrapolated to some extent to other Member States, because of the similarity of experiences and because of the common bonds between their legal sistems) will discuss/examine the genesis, the influence of political responsibility and possible iter connected to criminal liability. In this way we will interact it with the current reality and the concept of political responsibility by stimulating a critical view of the reader.
