Summary/Abstract: The right to life is enshrined in Article 2 of the ECHR, Article 6 of the ICCPR and their Protocols abolishing capital punishment. As a signatory of these human rights treaties, Serbia assumed a series of positive obligations, including the incorporation of this right in its positive regulations. The Constitution prescribes that human life is inviolable (Art. 24 (1)) and prohibits capital punishment (paragraph 2). The Constitution also prohibits measures derogating from the right to life during a state or war or emergency.
