Summary/Abstract: The author first analyses the rule of law as key precondition and crucial element of a democratic society and independence of the judiciary. Then she analyses the attempted reform of Serbia's judiciary over the past decade. The focus is on the current situation in Serbia's judiciary, especially the most recent reforms. The author meticulously analyses the roles of High Council of the Judiciary, State Chamber of Public Prosecutors of Ministry of Justice and the Constitutional Court of Serbia in the process of election of judges. The author concludes that elected judges still await the review of their election, two years after they had been elected. Judges in Serbia wait for their election, re-election or review of election for years and years. There is no certainty for them, nor for the citizens who wait for justice to be administered. And everybody in Serbia is farther and farther away from the rule of law.
