Summary/Abstract: Opinion concerns the compatibility with EU law of the proposal to exclude the application of the provisions of the Act on Personal Data Protection, specifying the rules for the processing of personal data in relation to the data processing for soldiers in candidate service. According to the authors, the processing of personal data of soldiers in candidate service takes place in the course of processing operations concerning defence within the meaning of Directive 95/46/EC of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data. The exception to the principles of personal data processing, as provided for in the bill, is in conformity with EU law.
