Summary/Abstract: This contribution analysis the possibilities of criminal prosecution of a new phenomenon called Cyberstalking in the Czech legislation. These possibilities have expanded especially after establishing the crime of stalking in the new Penal code no. 40/2009 Coll. For this reason the contribution focuses on this new legislation and is based primarily on the current Czech literature and existing case law of The Supreme Court of the Czech republic.
