Summary/Abstract: This article focuses on the theoretical research of the nature and the dynamics of the mechanisms and relations between the political system, legislative system, social time preference and the criminal phenomenon. The article has three parts: the first part contains the study of the general phenomenon of time preference; the second part contains the study of the relations between the political system and the legislative system, the incentive structure implied and the effects on the social time preference; and the last part contains the relation between the rise of social time preference and the criminal phenomenon. The research will show that the legislative system produces uncertainty in the social relations and the rise of social time preference. This rise of the social time preference stimulates the rise in criminal rate beyond the level that would have been reached in the absence of this rise (of the social time preference).
