Parliamentary immunity in European Union member states

Summary/Abstract: This article provides an analysis of the parliamentary immunity in European Union member states after its enlargement in May 2004. More specifi cally, it is focused on both types of immunity: “non-liability”, as well as “inviolability” across the European Union, comparing its principles and mentioning the differences among the States, namely: the scope, duration, persons covered, and procedure for its waiving. It attempts to outline draft historical background of both parliamentary immunity principles, which could explain such nuances in this fi eld among European states, caused by juridical traditions and customs in their past. The last chapter of this article deals with the parliamentary immunity of Deputies in the European Parliament. The analysis leads to a consideration on reflections of parliamentary immunity in the Czech constitutional system, especially the life-time duration of inviolability, which is unusual and unique in the European Union member states.
