Summary/Abstract: In democratic societies, the freedom of the individual is found in the legislative structures, by the people’s free access to the elaboration of laws. The organization of this type of society implies the existence and action of laws and has the lack of injustice as a goal. Therefore, the existence of laws has as a consequence the act of justice. Using these premises some can deduce that social order and social justice are equivalent. Things are different in totalitarian societies in which laws serve a single purpose, that of frustrating its subjects of the right to opinion and to determine them to obey, having no contribution to the lawmaking process.
