Summary/Abstract: In her paper, the author presents her position that the successful political rehabilitation should be connected to compensation of politically rehabilitated persons. However, unlike political rehabilitation, the 'restitution of victims of political repression' by rule encounters considerable difficulties. By analysing the causes of these difficulties and providing examples from the foreign legislation and practice, as well as the case law of the European Court for Human Rights, the author points the need that legislators in Serbia, already at the moment of the passing of the Law on rehabilitation of the victims of the political repression, must have a defined position on methods for legal regulation of right to damages of victims of political repression.
