Summary/Abstract: The new Act on the civil service, enacted on 21 November 2008, came into force on 24 March 2009. It introduced many important changes in the functioning of the civil service. This article analyses the new regulations contained in the Act on the civil service relating to change in the place of work of a civil servant. These are more restrictive than the previous measures provided by the Act of 2006, and allow transfers only to organizational units in which members of the civil service corps are employed. The Act on the civil service is a pragmatic employment measure, which regulates the legal status of members of the civil service differently than under general employment law. The employment status of members of the civil service corps is different in many respects from that of persons working under contracts of employment, and so the article also necessarily addresses issues such as place of working and changes to the terms of the employment relationship. The article describes the scope of possibilities of transferring a civil servant under the procedure of Articles 63, 64 and 66 of the Act on the civil service. Also discussed are the criteria and circumstances which may justify changing the terms of a civil servant’s employment relationship, the procedure available to a civil servant for appealing against a transfer decision, and sanctions in case of failure to abide by a decision of a person authorized to perform actions within the scope of employment law. The replacement of the measures of the 2006 Act on the civil service with those of the new Act of 2008 has created the possibility in law of creating a stable, permanent model for the civil service.
