PUBLIC DISCUSSION IN THE SPATIAL PLANNING PROCESS OF A MUNICIPALITY

Summary/Abstract: The subject of the Author’s considerations is the analysis of public discussion in the spatial planning process, one of the new instruments of the so-called participatory democracy, introduced in the spatial planning procedure by the Act dated 27 March 2003 on Spatial Planning and Development. Introducing public discussion at the stage of preparing the study of land use conditions and directions, and most of all the local spatial development plan, enabled local communities to express their opinions in matters concerning them. On the other hand, their opinions presented during public discussion allow decision makers to identify and solve problems or to turn their attention to the needs of the community. Public discussion referred to above has not been identified by the legislator. Likewise, its formula has not been specified. The article constitutes an attempt to define it, most of all by referring to the semantic linguistic interpretation. Defining public discussion facilitated moving on to specifying its formula, selecting the one which will enable to have the broadest participation in the discussion. The article also draws the Reader’s attention to the role of public discussion in the decision making process. The Author positively evaluates the introduction of public discussion devoted to planning acts to the planning procedure.
