Summary/Abstract: The proposal aims at harmonising national legislation in the area in which European Union has no exclusive competences. Therefore, it is subject to scrutiny by the national parliaments to assess its compliance with the subsidiarity principle. The article examines in detail the consistency of the proposed directive with the principle of subsidiarity. The authors prove that the proposal infringes the subsidiarity principle and those Treaty provisions which delineate the competences of EU legislative institutions.
