Actuality of prof. G.F. Shershenevich’s concept in the light of copyright

Summary/Abstract: Professor Shershenevich was a Russian lawyer of the Polish origin, who had a great influence on the Russian doctrine of law. The fact that he is still a subject of interest attests to his importance and proves significance of his input to civil law. Professor Shershenevich was active in many branches of law. Copyright law was also the subject matter of his studies. Professor is the author of the fundamental work in this field titled “Copyright to Literary Works” (published in June 1891). This work shows Professor’s competence and knowledge of tendencies in the European legal literature − in this work Professor refers to the Russian authors and also to the contemporary European doctrine: German and French. Professor Shershenevich used mentioned references as a background to formulate his own, original scientific position. It is important to underline that formulated by him theories were novel at his times − Professor saw in the author’s creativity an intangible good in the form of author’s thought, which is separate from the material object manifesting that thought. Professor Shershenevich analysed also the relation between the subject of copyright protection and ownership, in particular to a thing (res). The scientific achievements of Professor Shershenevich contribute significantly to the world doctrine of the copyrights and deserve to refer to it, to popularize it and to draw from it as a rich source of ideas of universal character which remain topical despite changing social and technical conditions.
