Statutory matrimonial property regime in the past and present: joint property or separate property?

Summary/Abstract: Gabriel Shershenevich considered matrimonial regime separate property for advanced asset guaranteeing women economic independence. He stressed that the couple should be as equal and independent, as before marriage. In Poland, 62 years matrimonial statutory property regime is the joint property (statutory joint property regime). Meanwhile, separate property with compensation for possessions gained (now one of the contractual property regimes) is fairer because it does not hurt anybody. De lege ferenda, the author suggests that the separate property with compensation for possessions gained became one of two alternative statutory property regimes.
