Summary/Abstract: The opinion deals with the issue of compliance with the Constitution of the Republic of Poland of a bill amending the Civil Code. The opinion does not provide an overall assessment of the coherence of the bill, its legislative purpose or correctness of terminology used therein. The author claims that the bill (except for Article 3) is consistent with the Constitution. The provisions of Article 3 – due to insufficient justification of constitutional rights, freedoms or principles – violate constitutional guarantees of property rights and trust in the state and law. Article 2 should also be removed. This provision is unclear, threatens the rights of property owners, and have no independent normative significance.
