Principles of interpreting the legal situation of a Deputy in the context of incompatibility of his mandate.

Summary/Abstract: The opinion presents the assumptions of interpretation of the provisions concerning incompatibility of the Deputy’s mandate. The Constitutional prohibition against the holding of a mandate of a Deputy jointly with other public functions is a consequence of the fundamental principles of the political system, including the principle of separation and balance of power and the related detailed rules. The authors describe and analyze particular instances of this prohibition in the Polish constitutional system.
