Summary/Abstract: The publication discusses the postulate appearing in the media of not announcing the Supreme Court’s resolution confirming the validity of the presidential election. According to the former First President of the Supreme Court, this would prevent the elected President from taking the oath, resulting in the Marshal of the Sejm temporarily assuming presidential duties. The concept raises serious doubts under the Constitution and Electoral Code. The polemical analysis is based on the formal-dogmatic method and literature review.
