Summary/Abstract: The subject of this paper is a commentary by the 14th-century jurist Lucas de Penna on one of the titles of Book 11 of the Justinian Code, dealing with the fact that cypress trees from the Syrian grove of Daphne or Egyptian persea trees should not be cut down and sold. The author of the commentary, in seeking to understand and clarify the content of the passages commented on, had to deal with terminology that was unclear in his time and with institutions that were not known at the time. The purpose of this article is to show how the author of a late medieval commentary on Byzantine law understood the content of this title and to determine whether his analysis sheds new light on our knowledge of tree stand protection in past centuries.
