Summary/Abstract: Pay transparency is of fundamental importance for the effective application of the principle of equal pay. Increased transparency may reveal potential gender biases within an enterprise’s remuneration structures and thereby enable employees, employers, and social partners to take appropriate measures to ensure the implementation of the principle of equal pay. Hence, the objective of Directive 2023/970, which must be transposed into national law by 7 June 2026, is to reduce informational asymmetry in the field of remuneration through both individual and collective measures. Collective measures include the employer’s informational and corrective obligations towards the workforce, while individual measures, which are the focus of this study, encompass the individual right of job applicants and employees to obtain remuneration-related information. The author examines the rights of prospective and current employees to access remuneration information, particularly their potential and limitations in uncovering and addressing pay inequalities.
