Summary/Abstract: This study, prepared for the Congress of Financial and Tax Law Departments and Institutes in Wrocław, on the 20th anniversary of Poland’s accession to the European Union (EU), examines selected objectives of the European Union from the perspective of their hierarchy, implementation, legal and financial implications. The European Union, as an entity aspiring to be a community of values, faces a number of obstacles along the way, and the tension between declarations and facts is one of its key challenges. The article shows how selected EU normative regulations are not in line with the EU’s treaty objective of building a highly competitive market economy. It should be noted that the EU’s ambitious political goals, enshrined in normatively binding standards of conduct, do not emphasise the need to ensure a balance between the many values enshrined in the treaties, and the pursuit of favoured goals often undermines the others. This is done, among other things, by imposing costly, complex, time-consuming and formal obligations on EU businesses that are not required of non-EU businesses; introducing customs exemptions for non-EU businesses that do not apply to EU businesses; or restricting banks’ freedom to finance the real economy by excluding the acquisition of assets from specific, legally operating sources, thereby implying risks to the stability of the banking system that finances the real economy.
