Summary/Abstract: The judgment delivered by the Court of Justice of the European Union in the case Centro di Musicologia Walter Stauffer provides a clear example of how EU law intervenes when national tax rules create differences in treatment between comparable situations. The dispute starts from a simple yet essential question, namely whether a Member State may grant a tax advantage only to entities established within its territory, while disregarding comparable entities established in other Member States. The Court answers firmly in the negative, holding that such a difference in treatment constitutes a restriction on the free movement of capital. At the same time, the judgment dismantles, one by one, the justifications put forward by the German State – from arguments relating to the need to avoid administrative difficulties to those concerning the protection of tax revenues – and reaffirms that these cannot prevail over the fundamental freedoms. Beyond the specific case, the judgment shows that EU law protects not only traditional economic operators, but also non‑profit entities when they participate in the economic sphere. At the same time, the Centro di Musicologia Walter Stauffer case‑law represents an important reference point for understanding the limits of the fiscal autonomy of Member States and the way in which the principle of non‑discrimination operates in practice.
