Summary/Abstract: In a recent case, acting in the spirit of Article 13 of the Fiscal Procedure Code, the Oradea Court of Appeal applied a teleological interpretation to the legal provisions – identifying the legislator’s intended purpose, examining the regulation’s original form and the rationale behind the rule’s adoption, and analyzing legislative amendments concerning the same legal situation. The Court thus concluded that a teleological interpretation of the provisions of Article I, paragraph (11) of Emergency Ordinance (O.U.G.) no. 106/2022 – which were applicable to the case – protects the end user by reducing the fuel price at the pump while simultaneously granting the economic operator who applied the 25‑bani‑per‑liter reduction along the distribution chain the right to obtain compensation from the state budget, regardless of whether the sale takes place at fuel depots or service stations.
