THE (IM)POSSIBILITY OF PROHIBITING THE EXERCISE OF AN ELECTIVE OFFICE THROUGH THE PREVENTIVE MEASURE OF JUDICIAL CONTROL

Summary/Abstract: This article demonstrates that the content of the preventive measure of judicialsupervision is restrictive regarding the obligations and prohibitions that may be imposed on thedefendant; consequently, it is forbidden to include within the scope of this measure obligations notexpressly provided for by law. Specifically, it is shown to be unlawful for the judicial authority toimpose on the defendant an obligation not to hold an elective office, only having the possibility ofprohibiting the exercise of the profession, trade, or activity in the course of which the offense wascommitted.
