Summary/Abstract: The article characterises the key legal regulations forming the basis for the operation of special services in the area of cybersecurity. The analysis covers both the solutions contained in the competence acts under which special services operate, and the legal norms contained in special acts, including the act on the national cybersecurity system. The effects of applying these regulations in practice are illustrated with data from the annual reports on the state of security of the cyberspace of the Republic of Poland, published by CSIRT GOV. Two key reasons are given for necessary changes: competence provisions under which special services carry out cybersecurity tasks are scattered across acts relating to various aspects of state security, mentioned almost incidentally; and special services are burdened with cybersecurity tasks simply because they are "special," without the specialisation necessary for real effectiveness. The conclusion is that the law should be changed to adopt a single comprehensive regulation, or even a law establishing a new special service with competences on the scale of the US National Security Agency (NSA).
