Summary/Abstract: A. Scalia, in expounding Originalism - his own concept of the correct way of conducting legal interpretation, particularly by a constitutional court - stands in opposition to judicial activism. The concept of originalism and the possibilities of its reception in Europe are the main subject of this work's considerations. Starting from Scalia's exposition on the value of originalism and how it is applied, scenarios in which it could be applied in Europe are considered, along with the changes that its transition could bring about in EU law.
