Order versus Safety in Transportation under Misdemeanours Law and Criminal Law

Summary/Abstract: This study presents a proposed understanding of the terms "order in transportation" and "safety in transportation" – terms that are prima facie obvious, yet, upon closer reflection, not entirely clear. Generally, the content of these terms is understood intuitively, and little attention is devoted to their details, since more practical importance is attached to work on specific offense definitions and their elements. In this study, the task of decoding these terms and juxtaposing them is instead made the main subject. The analysis is linked to the issues of the protected legal interest and the rules of due care. The whole may serve as a reflection on the practical application of provisions criminalizing acts directed against order or safety in transportation, benefiting the correctness of judicial decisions and increasing awareness of the values being protected.
