The e-Evidence Package as a New Tool for Cross-Border Cooperation in Criminal Matters

Summary/Abstract: This study is devoted to the issue of obtaining evidentiary material in digital form at the stage of preparatory proceedings. In particular, it analyses the new procedural measures provided for in the e-evidence package, i.e. the European Preservation Order (EPOC-PR) and the European Production Order (EPOC). The discussion is conducted using the example of a hypothetical factual scenario in which these instruments could be genuinely implemented in the course of criminal proceedings. The article discusses both the features distinguishing EPOC-PR and EPOC from classic transnational procedural tools, and an assessment of the possibilities for their potential application within preparatory proceedings.
