Summary/Abstract: Computer crime constitutes a growing challenge to the security of individuals and institutions worldwide. This article presents a comparative analysis of the legislation of selected Latin American and European countries, identifying three main approaches to penalizing the fraudulent exploitation of vulnerabilities in electronic data-processing systems: the creation of a separate offence of computer fraud, the adaptation and extension of classic fraud definitions to include computer-related forms, and the absence of a separate offence, with an emphasis instead on technical offences concerning interference with computer systems. Terminological and regulatory differences are highlighted that affect the effective prosecution of computer fraud and international cooperation in this area. Attention is drawn to the need to introduce dynamic regulation that takes account of technological progress, such as artificial intelligence and new techniques of digital manipulation.
