Summary/Abstract: The purpose of this study is to attempt to identify the fundamental problems associated with the functioning of a prison sentence served under the electronic monitoring system, to indicate the legal consequences of the adopted construction and solutions, and to outline directions for the development of this institution. Electronic monitoring is becoming an increasingly widely used tool, which raises further questions as to the limits of interference with the sphere of civil rights and freedoms. Has the use of electronic monitoring in criminal law clearly proven successful, and if so, to what extent could it be further developed, particularly in the context of technological progress? Are there any other fields of application in which electronic monitoring could be used? Should it be applied to perpetrators of a particular category of offences, and if so, to which ones and in what manner?
