Summary/Abstract: The text aims to address the question of what measures the Polish legislator should take in order to fully achieve the objective of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. In order to answer this question, the authors present the existing positions of national authorities and international bodies on the necessity of introducing a distinct crime of torture into the Polish Criminal Code, and compare these positions with the views expressed in jurisprudence and by legal practitioners. The authors’ analysis of these arguments supports the statement that torture should be codified as a distinct crime within the Polish Criminal Code. They assert that only through such legislative action can Poland meet its obligations under the CAT Convention and implement the long-standing recommendations of international bodies.
