Summary/Abstract: The Code of Criminal Procedure provides neither a separate legal basis for the inclusion of social media evidence into the trial, nor the actual standards and manner of its preservation. The sphere of social media publications may, to some extent, fall under the protection of the right to private life. One of the fundamental issues of limiting the ability to obtain and use these sources of evidence in the course of criminal proceedings remains open. Significantly, the issue related to possible evidentiary limitations arising from the sphere of private life has not been considered so far. The definition of the sphere of private life, in the case of social media, needs to be reinterpreted by leaving open the key questions regarding the element that prejudges the public or private nature of the relevant information.
