Summary/Abstract: In recent years, Europe has witnessed a growing prominence of far-right parties that—more or less openly—draw on the legacy of totalitarian and authoritarian systems. These movements often challenge the liberal-democratic order and promote various forms of historical revisionism. The aim of this article is to present the main legislative acts regulating the public promotion of fascism in Italy. The issue of criminalizing acts such as publicly advocating fascist or other totalitarian ideologies, as well as inciting hatred on the grounds of nationality, ethnicity, race, religion, or lack thereof, holds particular significance in the Italian context. Since 1946, the country has seen the legal operation of neo-fascist parties and movements referring to the legacy of Mussolini’s regime. Laws intended to prevent the resurgence of fascism—from the explicit provisions of the 1947 Constitution, through the Scelba Law of 1952, the Mancino Law of 1993, to the 2017 draft bill known as d.d.l. Fiano—are examined within their historical context. The final part of the article discusses how far-right parties’ attitudes toward these legal acts have evolved over time.
