Summary/Abstract: Lucas de Penna is the author of a commentary on the last three books (X-XII) of the Justinian Code, in which he also included some reflections on the problem of tyranny which was current in his time. The aim of this paper is to try to answer the question of what, in Lucas de Penna’s view, circumstances must be for tyranny to occur, what characterises this phenomenon and how to oppose it. The discussion will mainly focus on the commentary to C.10. 32: De decurionibus et filiis eorum et qui decuriones habentur quibus modis afortuna curiae liberentur, C.12, 63: Publicae laetitiae vel consulum nuntiatores vel insinuatores constitutionum et aliarum sacrarum vel iudicialium litterarum ex descriptione vel ab invitis ne quid accipiant immodicum and C.11. 47: Ut armorum usus inscio principe interdictus sit. The present study furthermore seeks to establish the factors that led Lucas to include a consideration of tyranny in his commentary on the last three books of the Codex and the reasons why the issue of tyranny was addressed precisely in the passages indicated above.
