Considerations on the manner in which the specific rules governing matrimonial regimes influence the rules on civil liability and contractual remedies. A study of certain particular applications

Summary/Abstract: In this article, we aim to analyse a series of situations in which the rules specific to matrimonial property regimes intersect with the classical mechanisms of civil liability and contractual remedies. The analysis will first address the nature of the liability incurred by the spouse who individually concludes a legal act subject to joint management, or a legal act falling within the sphere of parallel management, but which causes prejudice to the community of property. Subsequently, we shall examine the legal nature of contractual remedies to determine whether they constitute joint or separate property when they arise from a breach of obligation by a third party with whom one of the spouses has entered into a contract regarding joint property.
