DUTIES OF THE COMMERCIAL VESSEL MASTER IN CRIMINAL INVESTIGATION

Summary/Abstract: Abstract (en): The purpose of this article is to present the duties of the master of a commercial vessel in the context of criminal investigation on board the vessel, as well as the way in which he exercises his special and specific duties of ascertainment and cooperation with the judicial authorities, considering his dual capacity as a representative of the shipowner and a public authority in the exercise of his function. Both the Romanian legal framework and international regulations are presented, as well as practical implications regarding the obligations of ascertainment, collection and preservation of evidence, as well as cooperation with the authorities, concluding with proposals de lege ferenda regarding the clarification of the master's powers in the maritime criminal context.
