Summary/Abstract: Abstract (en): The article provides an analysis of judicial practice in Romania regarding the legality of applying disciplinary sanctions, emphasizing the need to ensure compliance with the fundamental principles of labor law and the procedures stipulated by the applicable legislation. The application of a disciplinary sanction has consequences on the employee’s professional career, as well as on their present and future conduct, thus it must be handled responsibly and in full legality. The conditions of legality that the employer must respect when applying a disciplinary sanction are highlighted, such as: the existence of an act attributable to the employee, the conduct of a prior disciplinary investigation, respecting the proportionality of the sanction in relation to the severity of the offense, and ensuring the right to defense. The analysis of court decisions highlights frequent errors by employers that lead to the annulment of sanctions in court, such as failure to comply with procedural deadlines or the lack of adequate motivation for the decision. The article provides recommendations, for the application, in accordance with labor legislation, of disciplinary procedures, and for reducing the number of disciplinary sanctions applied.
