Today we see it, and it’s not. What effects does the null and void act produce?

Summary/Abstract: The null and void act is considered to have never been concluded. That legal provision seems to shut down any discussion of the effects of such an act. Moreover, the court is obliged to analyze of its own motion any cause of absolute nullity. Therefore, the null and void act should not be effective, at least not when it reaches the court. And yet practice shows us that a series of such acts enter the civil circuit. This study aims to analyze this distance between theory and practice. Reviewing the three main sources of (knowledge) of law – doctrine, legislation and jurisprudence – the author finds the explanations why the system imagined by the authors of the Romanian Civil Code in 2011 did not have the expected echo and was largely ignored by practice.
