LAW ENFORCEMENT AS A LEGAL CATEGORY AND ITS COMPARISON WITH THE IMPLEMENTATION OF LAW IN GERMANY AND UKRAINE

Summary/Abstract: Theoretical approaches to the understanding of law enforcement, its main features and significance in the legal system, are considered. Particular attention is paid to a comparative analysis of law enforcement mechanisms in Germany and Ukraine, taking into account their legal traditions, sources of law, and respective peculiarities of judicial and administrative practice. Law enforcement in Germany is grounded in the system of continental law and is characterised by the stability of legal procedures, independence of the judiciary, and widespread use of precedent-setting decisions of higher courts. In Ukraine, the process of law enforcement is still evolving, due to both legal reforms and the adaptation of national legislation to European standards. Subsequently to the above analysis, the impact of international and European legal norms on national law enforcement mechanisms is studied. Major problems of law enforcement in Ukraine are identified; in particular, the uncertainty of legal norms, their conflict, and the complexity of implementing court decisions. Recommendations for the improvement of law enforcement activities are proposed, in particular, by raising the professional level of judges and law enforcement agencies, ensuring the independence of the judiciary and harmonising legislation with European standards.
