Aspects of criminal investigation concerning by means of technical surveillance methods

Summary/Abstract: Organized crime represents a criminal and antisocial phenomenon manifested within the national territory through the commission of unlawful acts constituting criminal offences, encompassing a diversified and continuously expanding sphere of activity as a consequence of the evolution of social life. The harmonization of domestic legislation with the regulatory framework of the European Union has contributed to increasing the effectiveness of the prevention and punishment of organized crime activities through interstate judicial cooperation and mutual legal assistance. Nevertheless, in Romania, crime rates remain significantly high, as evidenced by the report issued in 2023 by the National Association of Physical Security Risk Assessors of Romania.Through the present article, we aim to examine several issues arising from judicial practice and reflected in case law concerning the obtaining of evidentiary means during criminal investigations through technical surveillance methods. The evidentiary means and procedural mechanisms regulated under domestic legislation enable the identification of perpetrators of unlawful acts and the application, within criminal proceedings, of the appropriate sanctioning regime corresponding to each offence committed.
