THE RIGHT TO HAPPINESS, OR THE RIGHT TO PURSUIT HAPPINESS

Summary/Abstract: Happiness, a factor that underlies the multidisciplinary understanding of a variety of of social, political, legal and cultural phenomena gave rise to a right to happiness, part of the human rights belonging to the third generation. Whereas the right to happiness has emerged as a result of globalization and the evolution of human rights associated with the right to seek happiness, the analysis below focuses on the relationship between the right to happiness and the right to pursuit happiness, and findings show that the best way to understand a "right to happiness" is to look at it as a right to seek, to pursuit, happiness. The latter finds a much more solid foundation, while ensuring at the national, regional or international level respect or promotion of this right, including the introduction of a "Commissioner for happiness" represents objectives in the field of human rights.
