Summary/Abstract: The penitentiary and the church, institutions that appear to be excluded, are more than connected, the penitentiaries needing the religion, church, just as the church needs to exist in places of detention. Their need is, it can be said, complementary, people deprived of liberty need to be religiously, psychologically, sociologically supported for a real re-education, and religion aims precisely to direct people to the path of faith. The function of punishment for the re-education of persons deprived of liberty can be achieved through the collaboration of the church with the other institutions or authorities that have family protection competence, and the analysis of the effects of church and other family life protection factors on the lives of the detained persons is a desideratum. Last but not least, the identification of the legal basis of the possibility for detainees to benefit from the presence of church representatives in prisons is a direction to be followed.
