Summary/Abstract: The joinder in the proceedings of a third party who could claim, by means of a separate action, the same rights as the claimant constitutes a form of forced intervention which, due to the multiple advantages it entails, is regulated by the legislature under Article 68 of the Romanian Code of Civil Procedure. Nevertheless, this legal institution is not free from controversy, as its normative structure reveals certain shortcomings that allow legal doctrine to play a significant role in the interpretation of the relevant provisions of the Code. From the legal nature of the application to the effects that the judgment rendered on the merits produces in relation to the intervening third party, this paper aims to provide an overview of the competing doctrinal opinions.
