Summary/Abstract: This study examines the applicability of the provisions of Article 643 of the Romanian Civil Code concerning the exercise of legal actions and the opposability of judicial decisions in matters of co ownership within the legal framework of periodic ownership regulated by Articles 687 692 of the Civil Code. The issue is of particular doctrinal and practical interest, since periodic ownership constitutes a special form of co ownership characterized by the successive and repetitive exercise of the right of use over the same asset during distinct periods of time by different owners. The analysis starts from the interpretation of Article 689 para. (2) of the Civil Code, which provides for the corresponding application of the provisions of Article 643 of the Civil Code in cases involving acts of administration or disposition concluded with regard to the time interval pertaining to another co owner. In this context, the study aims to determine the scope and limits of the application of the rules established by Article 643 of the Civil Code in matters of periodic ownership, with particular emphasis on the effects of judicial decisions rendered in disputes relating to this right. The research examines, on the one hand, the compatibility between the mechanism of reciprocal procedural representation specific to co ownership and the legal particularities of periodic ownership and, on the other hand, the effects of favourable or unfavourable judgments rendered against one of the periodic co owners. At the same time, the study analyses the relationship between Article 643 para. (2) of the Civil Code and the principle of the relativity of the effects of judicial decisions, as well as the practical implications of the non opposability of unfavourable judgments toward co owners who did not participate in the proceedings. The study seeks to demonstrate that the express reference made by Article 689 para. (2) of the Civil Code is not merely formal in nature but rather confirms the applicability of the procedural mechanisms specific to co ownership also in the field of periodic ownership, albeit subject to an interpretation adapted to the particular characteristics of this legal institution.
