Selection of contract award criteria as a factor of public procurement efficiency in BiH: the relationship between the normative framework and practice

Summary/Abstract: In the public procurement system of Bosnia and Herzegovina, the economically most advantageous tender (EMAT) criterion remains in practice largely overshadowed by the lowest price criterion, although the legislative framework does not give precedence to either of them. This paper analyses the reasons behind such practice, with a particular focus on the operational and methodological challenges in applying the EMAT criterion, including issues related to the definition of sub-criteria and the distinction between the qualification phase and the tender evaluation phase. The research employs normative analysis, practice-based analysis, and a comparative method. The results indicate that the lack of clear guidelines and limited institutional capacity represent key obstacles to the broader application of this criterion. In conclusion, improving the system requires a combination of normative and institutional measures aimed at more efficient and rational public resource management.
